The terms,
in plain words.
What you can expect from Migraine Tracker, and what it is not.
Last updated:
These Terms of Use apply to the Migraine Tracker app for iPhone and Apple Watch, including its widgets and Live Activity, and to the migrainetrack.app website. They are provided by Linas Nutautas (“we”, “us” or “our”). By downloading or using Migraine Tracker, you agree to these Terms. If you do not agree, please do not use the app.
Using Migraine Tracker
Migraine Tracker helps you record migraine attacks, pain, symptoms, suspected triggers, medications and notes, review your history and create reports. It does not require an account. Some features need a compatible Apple device, permission to use Apple Health, location or notifications, an internet connection or a Premium subscription. Features and availability can vary by device, operating system and app version.
Apps downloaded from the App Store are also subject to Apple’s terms. Apple’s Standard End User License Agreement (EULA) applies to your licence to use the app. These Terms add to that agreement and do not replace it. Apple is not responsible for the app or its content and has no obligation to provide support for it.
Medical disclaimer
Migraine Tracker is a personal record-keeping tool. It is not a medical device and does not provide medical advice, diagnosis or treatment.
- The app does not diagnose migraine or any other condition, and it does not recommend, start, change or stop any treatment.
- Reports, statistics, trends and trigger or symptom summaries describe what you recorded. They do not establish the cause of your attacks and do not predict future attacks.
- The MIDAS assessment is a questionnaire about how headaches affected your activities. Its score and grade are for information and for discussion with a healthcare professional; they are not a diagnosis.
- Medication logs are a record of what you entered. The app does not give dosing advice and does not check for interactions, overuse or safety.
- Weather, pressure, sleep and heart-rate information comes from Apple Weather, Apple Health and your devices. It may be incomplete, delayed or inaccurate, and pressure alerts may not arrive.
Always talk to a doctor or other qualified healthcare professional about your symptoms, medicines and treatment. Do not ignore professional medical advice or delay seeking it because of something in the app or on this website. If you have a sudden, severe or unusual headache, or think you may have a medical emergency, contact your local emergency services immediately.
Premium subscriptions
Migraine Tracker is free to download and includes free features. Premium features are available through an auto-renewing subscription purchased in the app. Monthly and yearly plans may be offered. Before you confirm a purchase, the App Store shows the plan, billing period, price in your currency and any free trial you are eligible for. Prices and offers can vary by country and may change for future purchases or renewals under Apple’s rules.
- Payment. Payment is charged to your Apple account when you confirm the purchase, or when a free trial ends.
- Automatic renewal. Your subscription renews automatically for the same period and at the then-current price unless you turn off automatic renewal at least 24 hours before the end of the current period. Your account will be charged for renewal within the 24 hours before the current period ends.
- Free trials. If you start a free trial, it converts to the paid subscription shown at purchase unless you cancel at least 24 hours before the trial ends. Any unused part of a free trial is forfeited when you purchase a subscription, where applicable.
- Managing and cancelling. You can manage or cancel your subscription at any time in your Apple account settings (Settings → your name → Subscriptions on iPhone). Cancelling stops future renewals; Premium stays active until the end of the period you have paid for. Deleting the app does not cancel your subscription.
- Restoring. To restore Premium, for example on a new iPhone, use the restore option on the Premium screen while signed in with the Apple account you used to subscribe.
- Refunds. Apple handles refunds for App Store purchases. You can request one through Report a Problem. We cannot issue refunds directly.
Nothing in these Terms limits refund or other rights you have under consumer law where you live.
Your data
You own the information you enter. Your records are stored in the app on your device and are not synced to iCloud or to our servers, so we cannot recover them for you. If you lose or replace your device, or delete the app, your records can be lost unless your device backup includes them. You can export your attack data as CSV or JSON or create a PDF report; these exports are not a complete backup of every app record and setting. How we handle information is explained in our Privacy Policy.
Acceptable use
Use Migraine Tracker lawfully and for your own personal, non-commercial use. Do not interfere with the app or its services, bypass purchase or access restrictions, or copy, modify, distribute or reverse engineer the app, except where the law or the Apple EULA allows it.
Intellectual property
The app, website, name, icon, design, text and images belong to Linas Nutautas or their licensors. Using Migraine Tracker does not transfer those rights to you. Apple, Apple Watch, Apple Health and the App Store are trademarks of Apple Inc. Weather data is provided by Apple Weather; see the data sources.
Third-party services
Migraine Tracker works with Apple services, including the App Store, Apple Health and Apple Weather, and uses RevenueCat for subscriptions, TelemetryDeck for usage statistics and Sentry for crash reports. These services have their own terms and privacy policies, and their availability is outside our control. The Privacy Policy explains what information they receive.
Availability and limitation of liability
To the extent permitted by law, Migraine Tracker and its content are provided “as is” and “as available”, without warranties of any kind, including accuracy, reliability, uninterrupted operation or fitness for a particular purpose. We may change, add or remove features and supported devices as the app develops. This does not affect what you have already paid for under Apple’s rules or your rights under applicable law.
To the extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, for loss of data, or for decisions about your health made on the basis of the app or this website. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, such as liability for death or personal injury caused by negligence or for fraud, and nothing limits your mandatory consumer rights.
Changes and applicable law
We may update these Terms when the app, its services or the law change, and will update the date at the top of this page. If you continue to use the app after a change takes effect, the updated Terms apply. You keep the protection of the mandatory consumer laws of your country of residence and the right to bring a claim in its courts.
